1. Overview

Welcome to NeckGlo™. The terms "we", "us" and "our" refer to NeckGlo™, a business based in Québec, Canada. NeckGlo™ operates this store and website, including all related information, content, features, tools, products and services (the "Services"). NeckGlo™ is powered by Shopify, which enables us to provide the Services to you.

These Terms of Service (the "Terms"), together with our Privacy Policy, Refund & Return Policy, Shipping Policy and Legal Notice, govern your use of the Services and your purchases. By using the Services or placing an order, you agree to these Terms.

2. Eligibility and account

You must be at least the age of majority in your state, province or territory of residence to place an order. You agree to provide accurate, current and complete information and are responsible for keeping your account credentials secure.

3. Products

We make every effort to display our products accurately. Colours may vary depending on your screen. Our devices are personal cosmetic and wellness products, not medical devices; they are not intended to diagnose, treat, cure or prevent any disease, and individual results vary. Please read the safety information in our Legal Notice and the instructions supplied with the product before use. We may discontinue a product or limit quantities at any time.

4. Orders

Placing an order is an offer to purchase. We will send you an order confirmation by email. We may refuse or cancel an order (for example in case of suspected fraud, a pricing error or unavailability); if we do, we will notify you and fully refund any amount charged. Products are sold for personal use, not for resale.

5. Prices, taxes and payment

Prices are shown in U.S. dollars (USD) unless another currency is displayed at checkout. Applicable sales taxes (U.S. state sales tax, Canadian GST/HST/QST/PST) and any shipping charges are shown before you confirm your order. The price charged is the price in effect when you place your order. If a product is listed at an obviously incorrect price due to an error, we will contact you before shipping and give you the choice to confirm at the correct price or cancel for a full refund. Payments are processed securely by Shopify and its payment partners; we do not store your full card details.

6. Shipping, returns and refunds

Delivery times are estimates. Shipping is governed by our Shipping Policy and returns and refunds by our Refund & Return Policy. Risk of loss passes to you when the product is delivered to you.

7. Warranties and your legal rights

Our products come with the warranties required by law. Nothing in these Terms excludes or limits any right or warranty that you have under consumer protection laws that cannot be waived, including the legal warranty under Québec's Consumer Protection Act and Civil Code of Québec, other provincial consumer laws in Canada, and implied warranties under U.S. state law. Except as required by law, the Services are provided "as is" and "as available". Some jurisdictions do not allow the exclusion of certain warranties, so some of the above exclusions may not apply to you.

8. Limitation of liability

To the fullest extent permitted by applicable law, NeckGlo™, Shopify and their affiliates will not be liable for indirect, incidental, special or consequential damages arising from your use of the Services or products, and our total liability for any claim relating to a product will not exceed the amount you paid for it. This limitation does not apply to liability that cannot be limited by law, including where prohibited by Québec's Consumer Protection Act or other applicable consumer laws.

9. Intellectual property

All content on the Services (text, images, logos, videos, design) belongs to NeckGlo™ or its licensors and is protected by Canadian, U.S. and international intellectual property laws. You may use the Services for personal, non-commercial purposes only.

10. Reviews and feedback

If you submit a review or feedback, you confirm it is honest, based on your own experience and does not infringe anyone's rights, and you grant us a non-exclusive, royalty-free licence to display it on the Services. We do not edit reviews to change their meaning and we do not publish fake reviews.

11. Prohibited uses

You may not use the Services for any unlawful purpose, to infringe the rights of others, to transmit malware or spam, to impersonate anyone, to interfere with the security of the Services, or to scrape or collect data by automated means without our permission.

12. Relationship with Shopify

NeckGlo™ is powered by Shopify, which enables us to provide the Services to you. However, any sales and purchases you make in our store are made directly with NeckGlo™. By using the Services, you acknowledge and agree that Shopify is not responsible for any aspect of any sales between you and NeckGlo™, including any injury, damage, or loss resulting from purchased products and services. You hereby expressly release Shopify and its affiliates from all claims, damages, and liabilities arising from or related to your purchases and transactions with NeckGlo™.

13. Privacy

Your personal information is handled in accordance with our Privacy Policy and, where applicable, Shopify's Privacy Policy.

14. Governing law and disputes

These Terms are governed by the laws of the Province of Québec and the federal laws of Canada applicable therein. If you are a consumer, you also keep the protection of any mandatory provisions of the law of the province, territory or state where you live, and you may bring a claim before the courts of your place of residence where the law allows it. Please contact us first — most concerns can be resolved quickly by email.

15. Changes to these Terms

We may update these Terms from time to time. The version in effect when you place an order applies to that order. The current version is always available on this page.

16. Language

A French version of these Terms and our policies is available on request. / Une version française de ces conditions et de nos politiques est disponible sur demande.
